There’s something magical about October in New Mexico.  We are blessed with crisp mornings, vibrant colors, and of course, the Albuquerque International Balloon Fiesta painting our skies! What a view!

Join Us at the Hike to End Hunger

Saturday, October 18th from 10:00 am – 12:30 pm

We’re proud to support this year’s Hike to End Hunger event at Pat Hurley Park.  Join us for a dog-friendly, heart-heathy walk lined with food trucks, lawn games, face painting. What an amazing community event that helps raise awareness and fight food insecurity in our area. We’ll have board members helping with everything from registration and greeter stations to games and event support. Come hike, volunteer, or cheer. Every step helps!

Legal Updates

Federal Shutdown Ripples into NM Workplaces

With the federal government now in full shutdown mode, New Mexico employers with federal contractors, grantees, or employees face tangible legal and operational consequences. More than 20,000 federal civilian employees in New Mexico could be furloughed or required to work without pay. Under the Government Employee Fair Treatment Act of 2019, federal workers are entitled to retroactive pay once funding is restored, but that law offers no relief for contractors or subcontractors. Meanwhile, state unemployment offices will begin accepting claims from furloughed federal workers under “Unemployment Compensation for Federal Employees (UCFE).” For private employers with contracts tied to federal funding, delays or suspensions of federal agency operations may lead to payment disruptions, project delays, or even contract terminations. 

Key Legal and HR Pitfalls to Monitor

First, federal contractors must carefully review contract clauses on “no work / no pay” during funding lapses and confirm whether the agency will reimburse for idle time. In past shutdowns, many contractors were not reimbursed for downtime despite contractual expectations. Second, employers should be alert to wage-hour risks: if contract workers are among your workforce, are they being forced off duty without pay even though their classification (e.g., nonexempt) demands compensation for any “on call” or ready status? Third, employers in NM must expect upticks in uncertainty-driven turnover. Research shows that employees affected by a shutdown exhibit as much as a 31 % rise in voluntary separation after a furlough event.

Practical Steps for HR Teams

  1. Audit your Exposure - Identify which parts of your workforce or procurement chain depend on federal funding (directly or indirectly). For those roles, reexamine contract terms, notice obligations, and fallback payment provisions.
  2. Plan for Communication and Cash Flow - Prepare contingency messaging for employees or contractors impacted by delays, and ensure liquidity to absorb sudden gaps in federal reimbursement or project funding.
  3. Coordinate with State Supports - Help furloughed federal workers understand UCFE eligibility or state unemployment options, and monitor local workforce programs (such as those offered by NM’s Department of Workforce Solutions).
  4. Set Policy Guardrails - avoid ad hoc pay practices for impacted workers that could ripple into internal inequity or claims later; document decisions, timing, and business justifications.
